On September 28, 2015, the National Assembly of the Republic of Serbia adopted on Amendments to the Law on Mortgage.<\/p>\n
The aforementioned amendments in certain provisions require finality of the decision instead of non appealable of the decision in the process of registration and realization of mortgage operations.<\/p>\n
To the preparation of this law was approached bearing in mind that the decision of the Constitutional Court no. IUz-799\/2012 witch determined that the provision of Article 31, Paragraph 7 of the Law on Mortgage (“Off. Gazette of RS”, no. 115\/2005) in the part which reads: “and against it a claim or remedy shall not be allowed” is not in conformity with the Constitution.<\/p>\n
In order to maintain the effectiveness of extra-judicial sale procedure, changes allow a right on sell to the creditor starting from the day of the decision on the record of mortgage sales finality. In this way compliance with the regulations governing the operation of the competent real estate cadastre services is achieved and the final resolution on the submitted application is envisaged as a sufficient reason for deciding on the subsequently submitted applications.<\/p>\n
The changes are a way to implement the objectives defined by the Strategy for resolving loan problems approved by the Government of the Republic of Serbia, especially in the part related to the improvement of extrajudicial sale proceedings, but it also enables additional protection for parties who feel that first and second instance administrative organ did not acted properly in the process of an individual administrative act decision making.<\/p>\n","protected":false},"excerpt":{"rendered":"
